European Union Settlement Scheme

EEA and Swiss citizen and their family members need to  apply for European Settlement Scheme in order to continue to live in the UK after 30 June 2021. This is a mandatory requirement. After you apply you will be granted a status called ‘Settled Status’ or ‘Pre-settled Status’.

If you have been in the UK already for 5 years, you will be granted ‘Settled Status’. If not, you will be granted ‘Pre-settled Status’ provided you have been in the UK by 31 December 2020. After obtaining ‘Pre-settled Status’ when you complete your 5 years residence in the UK, you will be eligible for ‘Settled Status’.

‘Settled Status’ means you will not be under immigration control and be able to apply for citizenship upon meeting qualifying period which is generally 1 year of stay with ‘Settled Status’. It wise for someone who is approaching 5 years by 31 December 2020, he should wait and apply for ‘Settled Status’ without going through ‘Pre-settled Status’.

‘Pre-settled Status’ is granted for 5 years. Therefore, at the point when you complete your 5 years residence, you should apply for ‘Settled Status’ before your ‘Pre-settled Status’ expires.

Please also remember that there is a clear advantage of having ‘Settled Status’. It allows you to stay outside of the UK continuously for 5 years as opposed to 2 years in Immigration Rules which allows only 2 years to someone having Indefinite Leave to Remain (ILR).
