Private life – Leave to remain – person of 18 years and above but is in the UK for less than 20 years

Paragraph 276 ADE of the Immigration Rules allows leave to remain on the basis of private life in the UK. This is particularly important for someone whose stay in the UK is not on a lawful foundation. People who having met certain conditions shall be able to regularize their stay and eventually can apply for settlement and citizenship. As per Paragraph 276ADE, if you are:

  • under 18 and you have lived in the UK continuously for at least 7 years (discounting any period of imprisonment), and it would be unreasonable to expect you to leave the UK;
  • between 18 and 24 and you have lived continuously in the UK for more than half your life (discounting any period of imprisonment);
  • 18 or over and have spent less than 20 years (discounting any period of imprisonment) in the UK and you would face very significant problems if you have to live in the country you would have to go to.;
  • 25 or over and you have been in the UK continuously for 20 years (discounting any period of imprisonment);

It is to remembered that this route as an opportunity for a person aged 18 and above who is in the UK unlawfully for unavoidable circumstances and lived in this country for a long time but less than 20 years. As a result of their stay in the UK for such a long time, they have lost all possible ways to adapt with the condition prevailing in their own country. For example, they do not speak their ancestral language and could not learn it and the only language they know is English or only culture they are accustomed to is British culture. Thereby they have formed a very strong private life to be considered under Article 8 of ECHR.
