As an EU citizen if you are holding a pre-settled or settled status and married outside of the UK after 31 December 2020, can you bring your wife under an EU family permit? The definition of “spouse” for EU citizens does not allow it! In the annex of Appendix EU (Family Permit) to the Immigration Rule, a spouse is someone where
“the marriage was contracted before the specified date”. Here the specified date is 31 December 2020. So a free family permit can not be applied for your spouse. A spouse visa will cost £1523 only. Sad.
